Terms and Conditions

GENERAL TERMS AND CONDITIONS
AUTO GO s.r.o.
(hereinafter the "Terms")

Effective from: 1 July 2026

These General Terms and Conditions (hereinafter the "Terms") of AUTO GO s.r.o., Company ID (IČ): 01767542, VAT ID (DIČ): CZ01767542, registered office: Bořanovická 693, 250 64 Hovorčovice, Czech Republic, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 266666 (hereinafter the "Provider" or the "Lessor"), govern the mutual rights, obligations and principles of the contractual relationship between the Lessor on the one hand and the User or, as the case may be, the Lessee (see below) on the other hand.

By entering into the Framework Agreement, the User / Lessee confirms that they have carefully read these Terms, understand their content, accept their conditions and agree with them in full.

Article 1 – Definitions

For the purposes of these Terms, the terms below have the following meanings:

Administrative Fee – a fee to which the Lessor becomes entitled against the User/Lessee in cases where the Lessor or another person authorised by it is required to carry out an administrative or other act as a result of a breach of a contractual obligation by the Lessee, covering in particular the Lessor's costs associated with processing, recovering and administering receivables, fines, damages and other payments arising from the Agreement (the Framework Agreement or the Rental Agreement) and these Terms. The specific type and amount of each Administrative Fee is set out in Part II of Annex A to these Terms. An operating fee within the meaning of Part II of Annex A to these Terms is also considered an Administrative Fee.

Application – the Provider's platform for mobile devices (iOS/Android) through which the User manages their User Account.

Free Reservation Period – the period after the User confirms a reservation in the Application during which the User has the Vehicle reserved free of charge. The length of the Free Reservation Period is shown in the Application for the given Vehicle before the reservation begins, in the manner described in particular in Article 4.1 of these Terms.

Price List – the currently valid overview of prices that the User will pay the Lessor for using the Vehicle, including tariffs, rates, fees and penalties, which is displayed to the User when viewing the given Vehicle in the Application before the rental begins. The Price List is deemed to form part of the Rental Agreement. The version of the Price List valid at the moment the rental begins is always decisive.

Rental Period – the period from the moment the trip begins (by unlocking the Vehicle through the Application) until the moment the Vehicle is duly returned to the Lessor pursuant to Article 5 of these Terms.

Traffic Accident – an event in road traffic that occurred during the Rental Period or in direct connection with it and that resulted in personal injury, death, damage to the Vehicle, damage to other property, or other damage.

Corporate (User) Account – an account in the Application established exclusively for, and used by, a legal entity, serving to enable the Application to be used through such corporate account by natural persons to whom the legal entity grants use of the corporate account through the Application, whereby, when the corporate account is used, and in particular when a Rental Agreement is concluded through it, the legal entity is jointly and severally liable to the Lessor together with such natural person for all obligations, including obligations of a pecuniary nature, arising for such natural person as a registered driver. Further rules on the existence and operating conditions of a corporate account are set out in particular in Article 2.6 of these Terms.

IoT Device – an electronic hardware device installed in the Vehicle enabling remote locking/unlocking, location tracking, and recording of distance travelled, driving time, fuel consumption and other operating data, serving the Lessor for an overview of the Vehicle's location, mileage, etc.

Client Line – the Provider's/Lessor's customer support, available via a free telephone line, e-mail and chat in the Application; contact details are given on the Website and in the Application.

Charging Card – a card located in an electric Vehicle entitling the Lessee to draw electricity at the Lessor's partner charging stations at the Lessor's expense; it may be used exclusively to charge the Vehicle to which it is assigned.

Lessee – the User at the moment a Rental Agreement is concluded (acting in the legal position of a lessee within the meaning of Section 2321 et seq. of the Civil Code). A Lessee may be:

  1. a natural person over 20 years of age holding a valid driving licence of the relevant category issued at least one year before the date of registration.
  2. a legal entity that designates for the trip a specific natural person added by that legal entity in the Application (an added/assigned driver under a corporate account), whereby such natural person must be over 20 years of age and hold a valid driving licence of the relevant category issued at least one year before the date of registration.

Rental Agreement – an agreement under which the Lessor makes the Vehicle available to the Lessee for use and for which use the Lessee pays the Lessor amounts under the Price List valid at the moment the rental begins. The Rental Agreement arises at the moment the "Start rental" button (or an equivalent command) is pressed in the Application and terminates upon the proper ending of the rental pursuant to Article 5 of these Terms.

Fuel Card – a card located in a combustion-engine Vehicle entitling the holder to draw fuel at the Lessor's partner filling stations at the Lessor's expense; it may be used exclusively to refuel the Vehicle to which it is assigned, and not to purchase other goods or to dispense fuel into other containers or vehicles.

Paid Reservation Period – the period following the expiry of the Free Reservation Period during which the User has the Vehicle reserved for a fee under the Price List without having started a trip. The Paid Reservation Period ends at the moment the "Start rental" button is pressed, i.e. upon conclusion of the Rental Agreement.

Provider – AUTO GO s.r.o., Company ID (IČ): 01767542, VAT ID (DIČ): CZ01767542, registered office: Bořanovická 693, 250 64 Hovorčovice, Czech Republic. Registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 266666. The Provider administers the Application and User Accounts under the Agreement and, at the moment a trip begins / a Rental Agreement is concluded, acts as the Lessor.

Subject of the Rental (Vehicle) – a motor vehicle (a passenger car from the Lessor's current offering) provided to the Lessee for temporary use under a Rental Agreement.

Lessor – another designation of the Provider, as the owner or operator of the Vehicle or another person entitled to operate and make vehicles available for temporary use as part of a carsharing service in accordance with Section 2201 et seq. and Section 2321 et seq. of Act No. 89/2012 Coll., the Civil Code, as amended.

Operating Area – a geographically defined territory, exclusively within which the Rental Period may begin, continue and end, as delimited (marked) by the boundaries of such territory in the Application or as agreed in the Rental Agreement.

Framework Agreement – an agreement governing the terms of use of the Application and the Services, concluded between the Provider and the User in electronic form during the registration process, which does not exist as a separate document in either paper or electronic form, but is constituted by the content of these Terms as accepted by the User within the Application and by the Provider's acceptance of such consent in the form of activation of the User Account. These Terms form the direct content and an integral part of the Framework Agreement. Conclusion of the Framework Agreement does not give the User the right to demand that any Rental Agreement be concluded.

Penalty Fee / Contractual Penalty – a financial penalty which the User/Lessee is obliged to pay to the Lessor for breach of obligations arising from the Agreement or these Terms, in the amount set out in the applicable Schedule of Penalties (Part I of Annex A).

Services – all performance provided by the Lessor to the Lessee under the Agreement through the Application, in particular:

  • a) the Rental, i.e. making the Vehicle available to the Lessee for temporary use for a fee for the Rental Period, within the scope of the chosen Package (Light, Active, Pro) or Subscription (AutoGo Active, AutoGo Pro, AutoGo Premium);
  • b) arranging the reservation, opening/locking and handover of the Vehicle through the Application;
  • c) ensuring the Vehicle's roadworthiness, servicing, maintenance and insurance;
  • d) related assistance and support services (e.g. customer support, handling of Damage Events, administration of fines under the relevant provisions of the Agreement);
  • e) any supplementary services offered within the Application beyond the Rental (for example, optional supplementary insurance).

The term Services includes both the Rental itself and all related performance by the Lessor necessary to enable the Lessee to properly use the Vehicle in accordance with the Agreement.

Agreement – the Framework Agreement or a Rental Agreement under the Terms.

Deductible – the amount which the Lessee is obliged to pay to the Lessor in the event of damage to the Vehicle, even though the Lessee complied with the conditions of use of the Vehicle set out in the Terms, which is, for such cases, limited by the conditions and maximum amount payable within the meaning of Article 8.2 of the Terms. The Deductible does not apply in the cases set out in Article 8.3 of the Terms, where the Lessee pays the damage in full.

Damage Event – any accident, theft, damage, defect or other circumstance in which damage to the Vehicle, to third-party property or to health arose or should have arisen.

User – a natural or legal person (including drivers designated by it) who has completed registration in the Application and has a User Account established on the basis of the Framework Agreement. At the moment the User starts a trip in the Application (by pressing the "Start trip" button), they thereby conclude a Rental Agreement and, for the purposes of these Terms and of the contractual relationship itself, are referred to as the Lessee (see the definition above).

User Account – the User's personal account established in the Application upon completion of registration, serving for use of the Application by the User (Lessee).

Website – the Provider's/Lessor's website available at www.auto-go.cz.

Residual Value of the Vehicle means the usual (market) price of the Vehicle as determined by an expert opinion or professional estimate (e.g. by the insurer or a person authorised by it) at the moment immediately preceding the occurrence of the Damage Event, i.e. the price at which the Vehicle, in its given technical condition and age, could usually be sold on the market in the Czech Republic, disregarding the damage caused by that Damage Event.

Article 2 – Conclusion of the Agreement and Rental Conditions

2.1 Formation of the Contractual Relationship

The contractual relationship between the Provider/Lessor and the User/Lessee arises in two stages:

  • Framework Agreement – arises in electronic form at the moment the User ticks their consent to these Terms in the Application's registration form, submits the registration details requested by the Application, and the Provider confirms completion of registration by activating the User Account. The User acknowledges and agrees that the Framework Agreement is not drawn up as a separate contractual document, but that its content is fully determined by these Terms. The Framework Agreement establishes a general contractual framework for use of the Application and entitles the User subsequently to conclude Rental Agreements. Registration alone does not constitute conclusion of a Rental Agreement.
  • Rental Agreement – arises for each individual rental at the moment the User (in the position of Lessee) presses the "Start rental" button (or an equivalent command) in the Application after selecting a specific Vehicle. At that moment, the Lessee confirms, among other things, that they meet all the eligibility conditions under Article 2.2 and agree to the Price List valid at that moment.

The Provider/Lessor reserves the right to refuse registration in the Application or the conclusion of a Rental Agreement with any interested party, provided that the refusal is not motivated by reasons prohibited under anti-discrimination legislation (in particular Act No. 198/2009 Coll.).

2.2 User Eligibility Conditions

A User is entitled to register in the Application and use it only if the following conditions are met:

  • a minimum age of 20 (for passenger cars), or the age set for the relevant Vehicle category in the Price List or the Application;
  • a valid driving licence of the relevant category issued at least 1 year before the date of registration;
  • the driving licence has not been withdrawn, suspended or otherwise restricted as of the date of registration;
  • the User has no outstanding overdue liabilities towards the Provider.

2.3 Lessee Eligibility Conditions

A Lessee is entitled to use the Vehicle only if the following conditions are met:

  • the User's driving licence is valid and has not been withdrawn, suspended or restricted since registration;
  • the Lessee is not under the influence of alcohol (strict prohibition: 0.0 ‰), narcotics, psychotropic or other substances reducing the ability to drive;
  • the Lessee's state of health allows safe driving;
  • the User's User Account is not blocked;
  • the Lessee has no outstanding overdue liabilities towards the Lessor.

By starting each rental, the Lessee confirms that all of the above conditions are met. In the event of a false declaration, the Lessee bears full liability for any damage incurred.

2.4 Registration, Identity Verification and Account Administration

When registering in the Application, the User is obliged to provide complete, true and current information, in particular: a valid identity document (identity card), a valid driving licence, a contact mobile phone number, and a valid credit or debit card for payment purposes.

The Provider is entitled at any time, on its own initiative, to request an update of documents and verification of the validity of the driving licence, and the Lessee is obliged to comply with such request without delay. The Provider is further entitled at any time to block (temporary, reversible suspension of access) or cancel (permanent removal of the account) the User Account, in particular if:

  • the User has lost their driving licence or it has been withdrawn or suspended – the User is also obliged to notify the Provider of this fact without delay;
  • the User has breached the Framework Agreement, a Rental Agreement, or these Terms;
  • there is reasonable suspicion of fraudulent conduct by the User;
  • the User has outstanding overdue liabilities towards the Provider.

Blocking of the User Account is temporary, and the Provider will inform the User of the reason, unless prevented from doing so by law or an ongoing investigation. Cancellation of the User Account is permanent and occurs in particular in the event of repeated or serious breach of the Framework Agreement, a Rental Agreement, or the Terms.

2.5 Prohibition on Sharing the Account and Handing Over the Vehicle to Third Parties

The User must not share their login credentials in the Application with any third party, allow a third party to use the User Account or drive the Vehicle, or further rent out, assign or otherwise transfer the Vehicle or rights under the Agreement. A breach establishes the User's full liability towards the Provider and third parties for all damage, and the Provider's claim, including a claim for a Penalty Fee and cancellation of the User Account.

2.6 Corporate Accounts (Legal Entities)

A corporate account may be established exclusively by a legal entity (in particular an s.r.o., a.s. or another form of legal entity). Self-employed natural persons (OSVČ) use a standard individual account.

To establish a corporate account, the legal entity is obliged to: (i) provide identification and billing details (business name, registered office, Company ID (IČO), VAT ID (DIČ)); (ii) designate a contact person authorised to act on behalf of the corporate account; (iii) add and manage assigned registered drivers through the Application or the corporate portal; (iv) ensure that each registered driver accepts these Terms by their own confirmation upon their first registration.

Each registered driver, including a Lessee who is a natural person driving the vehicle under their own login, is liable for damage and breaches of conditions that occurred during a trip under their login. Where the Lessee is a legal entity as the holder of a corporate account, that legal entity is jointly and severally liable for all obligations of its assigned drivers towards the Lessor. The Lessor is entitled, at its own discretion, to invoice all costs and penalties to the Lessee (the legal entity) as a whole, to the specific driver, or partly to both.

Article 3 – The Application and the Licence to Use It

3.1 Availability and Requirements of the Application

For each rental, it is necessary to have the Application installed and functioning on a mobile device with an internet connection, to have a User Account established, and to meet the eligibility conditions under Article 2.2 of these Terms. The Application is available for devices running Android and Apple systems. The User bears all costs of data connectivity for their device, including any additional costs arising from defective data communication (e.g. lack of signal when ending a rental). The Provider endeavours to remedy faults in the Application as quickly as possible but does not guarantee unlimited and error-free functionality under all circumstances. The Provider is not liable for losses arising from the temporary malfunction or unavailability of the Application, except where the malfunction was caused intentionally or by gross negligence on the part of the Provider.

3.2 Licence to Use the Application

Provided that the User complies with the Framework Agreement and these Terms, the Provider grants the User a free, limited, non-exclusive, non-transferable and revocable licence to access and use the Application on the User's personal device, solely for the purpose of using the Services. This licence does not include the right to copy, modify, distribute or create derivative works from the Application.

3.3 Device Security

Rooting, jailbreaking or other modification of a mobile device contrary to the manufacturer's instructions increases the device's vulnerability to security threats. The Provider is not liable for losses arising in connection with the use of a device modified in such a way and has no obligation to support such a device.

Article 4 – Reservation and Commencement of Use of the Vehicle

4.1 Vehicle Reservation

The User makes a Vehicle reservation through the Application. The Free Reservation Period begins at the moment the reservation is confirmed in the Application by pressing the "Reserve" button and lasts for the period shown in the Application for the given Vehicle. Upon its expiry, the Paid Reservation Period automatically begins for a fee under the Price List. The Provider is entitled to cancel the reservation if the User does not start a trip within the maximum period set in the Application.

4.2 Commencement of Use of the Vehicle and Mandatory Inspection

Before pressing the "Start rental" button, the User is obliged to:

  • check the visible technical condition of the Subject of the Rental (hereinafter the "Vehicle") (exterior and interior of the Vehicle), the presence of all equipment and documents, and the cleanliness of the interior;
  • photograph the Vehicle properly, clearly and in sufficient light from all four sides (including close-ups of any damage or dirt found) – the photographs must be of sufficient quality and resolution, must be uploaded to the Application, and serve as evidence of the Vehicle's condition upon handover to the Lessee;
  • notify the Lessor without delay, through the Application or the Client Line, of any damage, faults or dirt found before use begins.

If the User does not detect and report damage or dirt before starting the trip, the Vehicle is deemed to have been free of defects and clean at the moment of handover, and any damage or dirt found after the end of the rental is deemed to have arisen during the Lessee's Rental Period. By pressing the "Start rental" button, the Lessee confirms that they have inspected the Vehicle, familiarised themselves with the operating instructions for the given type of Vehicle, and are fit to drive it safely.

4.3 Rental Period

The Rental Period begins at the moment the Vehicle is unlocked following the pressing of the "Start rental" button and is calculated in seconds; incomplete minutes are rounded up. It is the period from the moment the trip begins (by unlocking the Vehicle through the Application) until the moment the Vehicle is duly returned to the Lessor pursuant to Article 5 of these Terms.

Article 5 – Return of the Vehicle and End of the Rental

5.1 Moment the Rental Ends

The rental is ended, and the Vehicle is considered returned, only at the moment the Lessee fulfils all the conditions set out in Article 5.2 and confirms the "End trip" command in the Application and receives a summary of the ended rental. Until these conditions are met, the Rental Period continues to run and the Lessee remains fully liable for the Vehicle.

5.2 Obligations upon Return

Before confirming the "End trip" command, the Lessee is obliged to:

  • park the Vehicle within the Operating Area in a place that is publicly accessible at any time, in accordance with the rules of road traffic and parking regulations;
  • park the Vehicle only in a place where the nearest parking time restriction will not occur less than 12 hours after parking; this rule also applies to temporary parking bans announced in advance (e.g. due to street cleaning, events or construction works) if known to the Lessee at the time of parking or evident from the available traffic signage, failing which the Lessee shall be liable to the Lessor for any costs arising from breach of this obligation;
  • check the condition of the Subject of the Rental (exterior and interior) and photograph the Vehicle properly, clearly and in sufficient light from all four sides (including close-ups of any existing or new damage) – the photographs must be of sufficient quality and resolution, must be uploaded to the Application, and serve as binding evidence of the Vehicle's condition upon return by the Lessee;
  • report through the Application or the Client Line any damage, faults or dirt found upon return;
  • return the Vehicle with the fuel tank filled to at least 10% of the Vehicle's fuel tank capacity (petrol/diesel Vehicles) or with the battery charged to at least 20% of the Vehicle's capacity (electric Vehicles). Failure to comply with this obligation exposes the Lessee to a penalty under Part I of Annex A to these Terms;
  • return the Vehicle in a condition corresponding to its condition at handover, allowing for normal wear and tear;
  • leave all equipment, documents, and the Fuel Card / Charging Card in the Vehicle;
  • close the windows and doors and switch off the engine and ignition;
  • leave the interior clean, free of litter, food or other dirt.

If the Lessee parks the Vehicle in breach of the above conditions and, as a result, the Vehicle is towed away or a fine is imposed on it, the Lessee bears all costs thereby incurred by the Lessor, including Administrative Fees under Part II of Annex A to these Terms.

5.3 Technical Failure to End the Rental

If it is not possible to end the rental through the Application for technical reasons, the Lessee is obliged to contact the Client Line without delay and follow the Lessor's further instructions. The Lessee is obliged to remain with the Vehicle or ensure its safety until the situation is resolved. If the failure to end the rental is not caused by the Lessee, additional rental costs arising from a technical fault on the Lessor's side may be refunded to the Lessee. Fault on the Lessee's side arises in particular where the failure to end the rental was caused by the Vehicle being located outside the Operating Area, the windows or doors not being closed, the key not being in the designated place, or another breach of the conditions under Article 5.2 of these Terms.

5.4 Burden of Proof upon Return

The condition of the Vehicle upon return is evidenced by photographs taken by the Lessee under Article 5.2 and by IoT device data. The Lessor is obliged to demonstrate that damage found after the end of the rental arose during the Lessee's Rental Period. If the Lessee fails to submit photographs, they alone bear the burden of proof regarding the condition of the Vehicle upon return. The Lessor reserves the right to prove the occurrence of damage by other available evidentiary means. If the Lessor discovers damage, it will notify the Lessee without undue delay in writing through the Application or the Client Line.

5.5 Prohibited Places of Return

The Lessee must not return the Vehicle:

  • outside the Operating Area (without the Lessor's prior written consent);
  • in underground garages or private parking areas;
  • in paid parking lots of a private nature;
  • in places where parking is prohibited or restricted by traffic regulations;
  • in places with mechanical barriers or other obstructions.

5.6 Return Outside the Agreed Place

Return outside the Operating Area is permitted only with the Lessor's prior written consent. If the Vehicle is returned or left outside the Operating Area without the Lessor's prior written consent, the Lessee shall be obliged to reimburse the Lessor for all costs reasonably incurred in transporting the Vehicle back to the Operating Area, including Administrative Fees under Part II of Annex A to these Terms.

Article 6 – Rights and Obligations of the Lessee

6.1 Liability for the Vehicle during the Rental Period

Throughout the entire Rental Period – from the start of the rental under Article 4.3 until its proper end under Article 5.1 – the Lessee bears full liability for the Subject of the Rental, its condition, safe operation, and for any damage or breach of legal regulations occurring during that time. The Lessee is solely liable for the person driving the Vehicle; allowing a third party to drive without the Lessor's express permission is prohibited and does not release the Lessee from any of their contractual or statutory obligations. This liability continues regardless of whether the Lessee personally drives the Vehicle or has handed it over to another person to drive or use in breach of these Terms.

6.2 General Obligations

The Lessee is obliged to:

  • use the Vehicle solely for its intended purpose, with care and in accordance with the manufacturer's and the Lessor's instructions;
  • comply with all applicable legal regulations, road traffic rules and parking regulations;
  • take care of the Vehicle as a prudent person and protect it from damage, theft or unauthorised interference by third parties;
  • never leave documents in the parked Vehicle and always lock it properly;
  • regularly check operating fluids, tyre pressure and the technical condition of the Vehicle;
  • notify the Lessor without delay of any faults, defects or damage to the Vehicle;
  • immediately stop using the Vehicle if a warning light appears that would limit the Vehicle's roadworthiness, or if another safety circumstance arises, and contact the Lessor before continuing the trip, if at all;
  • report the exact location of the Vehicle to the Lessor and allow it to be inspected at the Lessor's request.

6.3 Prohibitions

The Lessee is strictly prohibited from:

  • driving the Vehicle under the influence of alcohol (strict prohibition: 0.0 ‰) or narcotics, psychotropic substances or medication reducing fitness to drive;
  • driving the Vehicle while tired, ill or otherwise unfit for safe driving;
  • driving in a manner endangering the safety of road traffic, in particular by driving at an inappropriate speed, in an aggressive or reckless manner, taking part in unauthorised (illegal) races or contests on public roads, or performing drifting (controlled skids) or other manoeuvres leading to intentional loss of traction;
  • allowing a third party to drive the Vehicle or use the User Account;
  • further renting out the Vehicle or assigning rights under the Framework or Rental Agreement to third parties;
  • using the Vehicle to drive off paved roads, for motor racing, vehicle testing or driving instruction;
  • using the Vehicle for the commercial carriage of persons or goods (taxi services, courier services, etc.) without the Lessor's express consent;
  • smoking or vaping in the Vehicle or allowing other persons to do so;
  • transporting animals other than in a closed transport container safely placed in the Vehicle;
  • grossly soiling the Vehicle or leaving litter in it;
  • carrying more passengers than permitted by the Vehicle's registration certificate;
  • transporting children or infants without the necessary booster seat or child seat; the Lessor does not provide child seats; if it is necessary to deactivate the passenger airbag, the Lessee is obliged to reactivate it at the end of the trip;
  • towing or transporting other vehicles without the Lessor's express permission;
  • carrying out any repairs, modifications or installation/removal of equipment on the Vehicle;
  • concealing damage arising from a Traffic Accident or avoiding liability for it;
  • interfering with, or attempting to access, the Vehicle's IoT device;
  • leaving the Vehicle with the engine running or the windows or doors open;
  • using the Vehicle to commit offences, crimes or other unlawful acts.

6.4 Use of the Vehicle Abroad

Without the Lessor's prior written consent, the Lessee must not take the Vehicle outside the territory of the Czech Republic. Even within any consent granted, the following restrictions apply:

  • Excluded countries: without express written consent, the Vehicle may be used only within the territory of EU Member States. Use of the Vehicle, or allowing its use, in non-EU Member States is prohibited, unless the Lessor grants the Lessee a prior exception, which shall apply only to the following countries: Albania, Andorra, Serbia, Montenegro, Belarus, Russia, Turkey, Israel, North Macedonia, Moldova, Ukraine, Bosnia and Herzegovina, and all countries outside the European continent.
  • The Vehicle must not be transported by ship or ferry.

A breach establishes the Lessor's claim to a Penalty Fee under Part I of Annex A to these Terms and the Lessee's full liability for any damage and costs incurred, which the Lessor incurs in connection with a breach of any of the above obligations by the Lessee.

6.5 Fuel and Charging

The Lessee is obliged to refuel only with fuel corresponding to the manufacturer's specification. The Fuel Card / Charging Card may be used only to refuel/charge the Vehicle to which it is assigned. The Lessee is obliged to report the loss of a Fuel Card / Charging Card to the Lessor no later than 2 hours after discovering the loss. The Lessee must not return the Vehicle with fuel below 10% of the tank's capacity; for electric vehicles, the battery level must be above 20% – otherwise the Lessee is obliged to return the electric Vehicle plugged in at the nearest charging station.

6.6 Smoking Ban

Smoking and vaping are strictly prohibited in all Vehicles. A breach is penalised under Part I of Annex A to these Terms.

Article 7 – Damage Events and Accidents

7.1 Lessee's Obligations upon a Damage Event

In the event of a Traffic Accident, theft, damage or other Damage Event, the Lessee is obliged to:

  • stop immediately, secure the scene of the accident and provide first aid to any injured persons;
  • call the Police of the Czech Republic (158) without delay if the damage exceeds CZK 200,000, if any person was injured or killed, or if it is not possible to clearly determine who was at fault;
  • inform the Lessor without delay through the Application or the Client Line, no later than 1 hour after discovering the Damage Event, providing: the place and time of the event, a brief description of the circumstances and cause, identification of the other party involved (name, contact details, registration plate, insurer), any personal injuries, and photographic documentation of the scene and the damaged vehicles;
  • fully and properly complete the accident report form located in the Vehicle (if this document is not present in the Vehicle, a tool such as Bouracka.cz or an equivalent may be used) and send it to the Lessor without delay;
  • secure the Vehicle against further damage or theft if it is not roadworthy;
  • not accept any liability or make similar statements towards third parties - such statements bind only the Lessee personally and are not binding on the Lessor or the insurer;
  • hand over to the Lessor all documents and completed forms within 24 hours of the Damage Event occurring;
  • provide the Lessor, the Police and the insurer with full cooperation in investigating the event.

A breach of the obligations under this Article establishes the Lessor's claim to Penalty Fees within the meaning of Part I of Annex A – the Schedule of Penalties and Fees, as well as the Lessee's full liability for any damage arising as a result of such breach and for activities reasonably incurred by the Lessor to remedy the breach of related obligations by the Lessee.

7.2 Ending the Rental when the Vehicle Is Not Roadworthy

In the event of an accident or breakdown after which it is not possible to continue driving the Vehicle safely, the Rental Period ends at the latest at the moment the Vehicle is handed over to a towing service approved by the Lessor. Only the Lessor is entitled to choose the towing service and the repair shop; the Lessee must not make these choices independently without the Lessor's prior consent.

7.3 Assignment of Insurance Proceeds

The Lessor is entitled to all compensation for damage paid by a third party (an insurer or other entity) in connection with damage to the Vehicle. If the Lessee receives any such payment, they are obliged to notify the Lessor of this fact without delay and to transfer the relevant amount to the Lessor's bank account.

7.4 Fault or Defect of the Vehicle

If the Lessee discovers a fault, warning signals or another condition precluding safe operation of the Vehicle, they are obliged, no later than 1 hour after discovering it, to: (i) stop using the Vehicle, (ii) inform the Lessor, and (iii) follow the Lessor's further instructions before continuing the trip, if at all. The Lessor is entitled to unilaterally end the Rental Period, including remotely through the IoT device, if a situation arises that endangers safety, if a payment fails, or in the event of a serious breach of the Agreement.

7.5 Compensation for Lost Profit

The Lessee is obliged to pay the Lessor lost profit for the period during which the Vehicle is under repair as a result of damage caused by the Lessee. The amount of lost profit which the Lessee is obliged to pay the Lessor corresponds to the average daily revenue of one Vehicle, calculated on the basis of renting out all Vehicles of the same model over the preceding thirty-day period (for example, where the Lessor has twenty Vehicles of the same model, the daily revenue of these twenty Vehicles over the preceding 30 days will be averaged, and the resulting revenue attributable to one Vehicle will form the basis for calculating the lost profit for the Vehicle that the Lessor is unable to use due to its repair).

7.6 Method of Quantifying Actual Damage

The amount of actual damage to the Vehicle is quantified using one of the following methods, at the Lessor's choice: (i) the price list of an authorised or contractual service centre, (ii) standardised calculation software (e.g. Audatex or equivalent), or (iii) an expert opinion or the statement of a professional. Quantification of damage using these methods takes precedence over estimates arising from misdemeanour, criminal or other proceedings. The Lessee has the right to comment on the result, but this does not exclude the obligation to pay.

7.7 Tyre Defect and Towing of the Vehicle

In the event of a tyre defect or other fault rendering the Vehicle not roadworthy, the Lessee is obliged to inform the Lessor without delay through the Application or the Client Line and to follow its instructions. The costs of towing the Vehicle to the nearest contractual service centre are always borne by the Lessee, regardless of the cause of the fault. Repair costs are added to the towing costs if the fault arose through the Lessee's fault or negligence.

Article 8 – Insurance and Liability for Damage

8.1 Insurance Cover Provided by the Lessor

The Lessor provides statutory motor third-party liability insurance for the Vehicle (compulsory insurance). Proof of insurance is included among the Vehicle's equipment. The Lessee is entitled to request the insurance terms at any time.

8.2 Principle, Origination and Amount of the Deductible

Deductible: The Deductible represents the Lessee's obligation to pay the Lessor a specific amount in the event of damage to the Vehicle, even though the Lessee complied with the conditions for use of the Vehicle set out in the Terms, which is, for such cases, limited by the conditions and maximum amount payable within the meaning of Article 8.2 of the Terms.

Origination of the Lessee's right to an obligation to pay only up to the amount of the Deductible, without an obligation to pay damages in full: The right to a limitation of financial liability up to the amount of the Deductible arises for the Lessee automatically at the moment the Rental Agreement is concluded (upon the start of the rental under Article 4.3 of the Terms), provided that these Terms and applicable law are duly complied with.

Amount of the Deductible according to the Vehicle category: The Lessee's liability under the agreed Deductible depends on the category of the given Vehicle:

  • Category City: max. CZK 30,000
  • Category Premium: max. CZK 50,000
  • Category Luxury: max. CZK 75,000
  • Category Cargo: max. CZK 50,000

The Vehicle's category can be found by the User for each Vehicle when selecting a Vehicle in the Operating Area of the Application.

8.3 Unlimited Liability of the Lessee

The limitation of liability under Article 8.2 does not apply, and the Lessee bears full unlimited liability, in particular in cases where:

  • the damage was caused intentionally or through the Lessee's gross negligence;
  • the Lessee was under the influence of alcohol, narcotics, psychotropic substances or medication;
  • the Lessee refused to undergo a test for the presence of alcohol or other substances;
  • the Vehicle was driven by a third party to whom the Lessee allowed access to the Application or use of the Vehicle;
  • the Lessee left the scene of the accident or failed to comply with the notification obligations under Article 7.1;
  • the damage arose while the Vehicle was being driven by a person without a valid driving licence;
  • the insurer refused to provide insurance indemnity or reduced it for a reason attributable to the Lessee, in particular for breach of the insurance conditions, improper operation of the Vehicle, failure to provide documents, failure to provide an explanation or other cooperation required by the insurer in connection with investigating the insured event, or for failure to submit documents required by the insurer;
  • the damage is not an insured event (e.g. damage to the interior, loss of keys, documents or the Fuel Card);
  • a total loss of the Vehicle occurs - the Lessee pays the difference between the Residual Value of the Vehicle immediately before the occurrence of the Damage Event that led to the total loss and the price for which the Vehicle was subsequently sold or auctioned;
  • the damage arose as a result of a breach of applicable regulations governing road traffic or a failure to adapt the manner of driving to traffic conditions (in particular Section 18 of Act No. 361/2000 Coll.).

8.4 Limitation of Liability of the Lessor and the Provider

The Lessor is not liable to the Lessee for damage, except for damage caused intentionally or by gross negligence. In other cases, the Lessor is liable only for breach of material contractual obligations, and only up to the amount of typical, foreseeable damage at the time the Agreement was concluded. Material contractual obligations are those the fulfilment of which enables proper performance of the Agreement and on the observance of which the User relies. This limitation does not apply to cases of injury to life, health or body, nor to cases of fraudulent concealment of defects or the assumption of a warranty. The Provider is likewise not liable for damage arising from the temporary unavailability or malfunction of the Application or the Vehicle caused by circumstances beyond the Provider's control.

Article 9 – Rental Charges, Payments and Re-invoicing

9.1 Amount of the Rental Charge

The amount of the rental charge (the Fee for Services) consists of: (a) a component for the time of use, calculated in minutes; (b) a component for the distance travelled - number of km × the rate under the Price List; (c) any fee for the Paid Reservation Period; (d) statutory VAT and other mandatory fees. The Price List may be dynamic – its level may vary depending on time, location or demand. The current Price List is always shown to the User in the Application before the rental begins. By starting the trip, the Lessee confirms their agreement to the Price List valid at that moment.

9.2 What the Rental Charge Includes and Excludes

The rental charge includes: the cost of fuel and charging of the Vehicle drawn using the Lessor's card, parking in blue and purple zones outside the Rental Period, the motorway toll sticker for the territory of the Czech Republic, and compulsory insurance for the Vehicle. The rental charge does not include: tolls and road charges abroad, parking in blue and purple zones during the Rental Period, fines for offences, comprehensive (collision damage) insurance, and Penalty Fees and compensation for damage under these Terms.

9.3 Method of Payment and Automatic Debiting

The User or Lessee pays all amounts arising from use of the Vehicle, from the Agreement (Framework or Rental) and from these Terms by payment card (VISA or Mastercard) or another method linked to the User Account. The User hereby grants the Provider consent to the automatic debiting of all such payments without the need for any further individual consent. The User is obliged to ensure sufficient cover on the card. If a payment cannot be processed, the Provider is entitled to suspend or end the Rental Period and to block the User Account.

The rental charge for a completed trip will be debited immediately after the end of the Rental Period. Penalties, compensation for damage and other additional fees will be debited either on the basis of the User's express consent given in the Application, or automatically 14 days after notification to the User, whichever occurs first; this does not apply to amounts that are clearly disputed between the parties as to their basis or amount.

9.4 Re-invoicing of Penalties Imposed by Public Authorities

If a fine or other monetary penalty is imposed on the Lessor, as the operator of the Vehicle, by a competent public authority (in particular the Police of the Czech Republic, municipal police, an administrative authority, or a road operator) for an offence committed by the Lessee during the Rental Period – typically for exceeding the maximum permitted speed, unauthorised parking, or another breach of road traffic rules – the Lessor is entitled to pay such penalty in its own name and subsequently re-invoice it to the Lessee in full, increased by the relevant Administrative Fee under Part II of Annex A to these Terms. The same applies where the Lessee, during the Rental Period, parks the Vehicle in breach of road traffic rules or other legal regulations and the resulting unlawful state continues even after the end of the Rental Period, with the fine or other penalty being imposed only after the Rental Period has ended. Liability for such an offence, and the obligation to pay for it, rests with the Lessee who parked the Vehicle in breach of the rules, unless the Vehicle was in the meantime handed over, without any detriment to the Lessor, to another lessee for use or taken back by the Lessor.

The re-invoicing procedure is as follows:

  • The Lessor will notify the Lessee in writing of each such penalty (by e-mail or through the Application), stating the amount of the penalty, its reason, the authority that imposed it, and the date on which the total amount owed (the penalty + the Administrative Fee) will be automatically debited using the payment method selected by the Lessee in the Application (hereinafter the "automatic debit date"). The automatic debit date must not be set earlier than 14 days after delivery of the notice.
  • The Lessee is entitled to submit a written objection within 14 days of delivery of the notice. The objection must be substantively justified and supported by relevant evidence (e.g. evidence that the Lessee was not driving the Vehicle at the given time and place). A mere general denial of liability is not considered a substantive objection.
  • Submitting an objection does not postpone the automatic debiting of the amount owed. The Lessor will review the objection without undue delay. If it finds the objection justified, it will refund the debited amount, or the relevant part of it, to the Lessee's payment method.
  • If the Lessee does not raise an objection within the 14-day period from delivery of the notice, the total amount owed will be automatically debited on the automatic debit date without further notice. Upon expiry of the deadline without an objection having been filed, the Lessee confirms that they acknowledge the claim and the deadline is deemed to have lapsed without action (missed).

The Lessor is also entitled to share the Lessee's identification and contact details with the relevant public authorities for the purpose of identifying the driver in misdemeanour or other proceedings.

9.5 Deposit

The Lessor is entitled, before the rental begins, to carry out a preliminary authorisation (hold) of a reasonable deposit on the User's payment card. The User will be informed of the amount of the deposit before it is authorised.

9.6 Invoices and Documents

The Provider/Lessor will issue the User with a tax document for each provision of a Service. Documents are available in the User Account.

9.7 Late Payment

In the event of a delay in paying any monetary amount, the User or Lessee is obliged to pay contractual default interest of 0.1% of the amount owed for each commenced day of delay. The Provider/Lessor is entitled to assign receivables to a collection agency or to a court; all recovery costs are borne by the User/Lessee.

9.8 Limitation of the Right of Retention

The User/Lessee is entitled to exercise a right to withhold payment against the Provider/Lessor only where their counterclaim has been awarded by a final and binding decision of a court or an administrative authority. A general denial of a claim, or the filing of an objection under Article 9.4 of these Terms, does not in itself establish a right to withhold payment. The Lessee is not entitled to set off any claim against the Lessor against a claim of the Lessor against the Lessee.

Article 10 – Penalties, Contractual Penalties and Their Limitation

10.1 Schedule of Penalties

For breach of obligations arising from the Framework Agreement, a Rental Agreement, or the Terms, the Provider/Lessor is entitled to apply Penalty Fees under the current Part I of Annex A to these Terms.

10.2 Condition of Fault

A contractual penalty or Penalty Fee will not be imposed on the User or the Lessee if the User or Lessee proves that the relevant breach did not occur through their fault. A User or Lessee who claims the absence of fault is obliged to substantiate this fact with relevant evidence without undue delay after receiving notice of the imposition of the penalty.

10.3 Cumulation of Claims

Payment of a Penalty Fee does not relieve the User or Lessee of the obligation to fulfil the relevant obligation, nor does it limit the Provider's/Lessor's right to full compensation for damage. Contractual penalties are deducted from compensation for damage only where this is expressly provided.

10.4 Right to Reduce a Penalty

The Provider/Lessor reserves the right to reduce the amount of a Penalty Fee having regard to the seriousness of the breach, the circumstances of the particular case, and the degree of fault of the User or Lessee.

Article 11 – Rights and Obligations of the Lessor

11.1 Obligations and Entitlements of the Lessor

The Lessor undertakes to:

  • hand over the Vehicle to the Lessee in good technical condition;
  • provide statutory insurance cover for the Vehicle (compulsory insurance);
  • carry out regular service inspections and technical checks of the Vehicle;
  • inform the User of changes to the Terms in the manner set out in Article 14; the Price List changes on an ongoing basis without prior notice, and the current version is always available in the Application.

The Lessor is entitled to:

  • inspect the Vehicle at any time – the Lessee is obliged to allow such inspection;
  • monitor the location and operating data of the Vehicle through the IoT device throughout the duration of the Agreement;
  • unilaterally end the Rental Period remotely through the IoT device where safety is endangered, in the event of payment failure, or in the event of a serious breach of the Agreement;
  • block or cancel the User Account in the event of a breach of the Agreement or suspicion of fraud;
  • assign receivables owed by the Lessee or the User to third parties;
  • withdraw a Vehicle from operation for operational reasons or due to the end of its financing, undertaking in such case to offer a replacement vehicle of a comparable type;
  • unilaterally change the Terms or the conditions of the rental relationship in the manner set out in particular in Article 14 of these Terms.

11.2 Items Left in the Vehicle

The Lessor is not liable for items left in, or stolen from, the Vehicle. The Lessee is obliged, at the end of the trip, to check that they have not left any personal belongings in the Vehicle. Items found in the Vehicle will be kept for 30 days; thereafter they will be disposed of or donated to charity.

Article 12 – Duration, Extension and Termination of the Agreement

12.1 Duration

The Framework Agreement is concluded for an indefinite period. Rental Agreements are concluded for a fixed period, which elapses upon the ending of the trip pursuant to Article 5.1 of these Terms.

12.2 Termination of the Framework Agreement

The Framework Agreement may be terminated:

  • by written notice from the User or the Provider, including without stating a reason, with a two-week notice period beginning on the day the notice is delivered to the Provider; notice may be given through the Application, by e-mail, or by registered mail;
  • by immediate termination by the Provider in the event of a material breach of the Framework Agreement or the Terms by the User; where the nature of the breach permits remedy, in the Provider's opinion, the Provider will first give the User written notice to remedy it within a period of at least 3 days; this does not apply to cases endangering safety, criminal conduct, or cases of repeated breach of the Terms or the conditions of the Framework Agreement; in the case of immediate termination, the Framework Agreement ends on the day the immediate notice is delivered to the User;
  • by agreement of both parties.

Notice of termination or another written communication is deemed delivered: (i) through the Application – at the moment of sending; (ii) by e-mail – at the moment of delivery to the address given in the User Account; (iii) by registered mail – on the third business day after dispatch.

12.3 Withdrawal from the Agreement (Consumers)

A User who is a consumer has the right to withdraw from the Framework Agreement within 14 days of its conclusion, including without stating a reason. A model form is set out in Annex B to these Terms. It is not possible to withdraw from a Rental Agreement pursuant to Section 1837(a) of Act No. 89/2012 Coll.; the rental charge paid for the period of actual rental is non-refundable.

Article 13 – Protection of Personal Data

The Provider processes personal data of the User and of the User's data in accordance with Regulation (EU) 2016/679 (GDPR) and Act No. 110/2019 Coll. Detailed information is set out in the Privacy Notice available on the Website and in the Application.

The Provider/Lessor is entitled to share the personal data of the User and the Lessee with third parties (insurers, the Police of the Czech Republic, courts, collection agencies, administrative authorities) to the extent necessary to enforce rights under the Agreement (Framework or Rental), to conduct proceedings, or to fulfil a statutory obligation.

Vehicles are equipped with an IoT device recording location, distance travelled, driving time, driving style and other operating parameters. The Lessor is further entitled to contact the Lessee during the Rental Period upon detecting extraordinary events, a fault, or non-standard behaviour of the Vehicle. The User consents to this processing by entering into the Agreement.

Article 14 – Changes to the Terms

The Provider/Lessor is entitled to unilaterally amend these Terms at any time. Each change will be notified to the User by e-mail or through the Application no later than 14 days before the proposed effective date (except for changes required by law or for security reasons). If the User does not agree with the change, they are entitled to give written notice terminating the Framework Agreement within 10 days of the notification, without a notice period. If notice is not given within this ten-day period, the User is thereby deemed to consent to the amended Terms being binding on them, effective from the day the change was notified to them. If the Terms change during the course of a rental, the Terms in effect at the time the rental arose remain applicable until the end of that rental.

Article 15 – Other and Final Provisions

15.1 Governing Law and Dispute Resolution

The Agreement is governed by the law of the Czech Republic. Any disputes will be resolved by the competent court in the Czech Republic having subject-matter and territorial jurisdiction. A User who is a consumer is entitled to approach the Czech Trade Inspection Authority (adr@coi.cz; www.adr.coi.cz) as a body for the out-of-court resolution of consumer disputes.

15.2 Handling of Complaints

Complaints may be submitted through the Application, by e-mail to info@autogo.cz, or through the Client Line. The Provider will handle complaints no later than 30 days after receipt.

15.3 Contractual Penalties and Compensation for Damage

Payment of contractual penalties does not in any way affect the Provider's/Lessor's right to full compensation for damage, unless the Terms or the Agreement provide otherwise.

15.4 Severability

If any provision becomes invalid or ineffective, the remaining provisions remain fully valid. An invalid provision will be replaced by a valid provision that best reflects the original intent of the parties.

15.5 Language of the Agreement

The Agreement and the Terms are concluded and interpreted in the Czech language, which is decisive. In the event of any ambiguity in the interpretation of any provision of these Terms, the interpretation adopted by the Lessor, as the author of the Terms, shall apply.

15.6 Delivery

Notices are delivered: (i) through the Application – at the moment of sending; (ii) by e-mail to the address given in the User Account - at the moment of delivery; (iii) by registered mail - on the third business day after dispatch. The User is obliged to keep their contact details up to date.

15.7 Call Recording

The Provider/Lessor is entitled to record calls with the Client Line for quality-control purposes, and the User/Lessee acknowledges this and agrees to it. The User is informed of the recording by an automatic notice at the start of each call.

15.8 Blocking of the User Account

The Provider is entitled to immediately and without prior notice block or cancel the User Account, in particular where there is reasonable suspicion of a breach of the Framework or Rental Agreement, fraud, late payment, withdrawal of a driving licence, or suspicion that a crime or offence has been committed by the User or Lessee. The Provider will inform the User of the blocking and state the basic reason, unless prevented from doing so by law or an ongoing investigation.

15.9 User's Declaration

By electronically accepting the Terms, the User declares that: they have carefully read the Terms and their annexes and agree with them; they have provided complete and true personal data; they meet the eligibility conditions under Article 2.2 of these Terms; and they understand that the Vehicle is monitored through the IoT device.

Annex A – Schedule of Penalties and Fees

If you comply with the conditions of the Framework and Rental Agreement and applicable traffic regulations, none of the fees listed below will apply to you. The imposition of a penalty does not relieve the User or Lessee of the obligation to compensate the Provider/Lessor in full for any damage incurred. The Provider/Lessor may claim compensation for damage exceeding the penalties listed below. The amounts stated are prices excluding VAT, which the Provider/Lessor is entitled to add to the relevant mandatory payment.
